Are you aware that survivors of domestic violence have significant rights they can exercise during criminal proceedings against their abusive partner?


In New Hampshire, victims have the following rights under RSA 21-M:8-k:

1ļøāƒ£ The right to be reasonably protected from the accused throughout the criminal justice process (II(c));


2ļøāƒ£ The right to reasonable and timely notice of all court proceedings, including post-conviction, parole, and probation hearings (II(d));


3ļøāƒ£ The right, on the same basis as the accused, to attend trial and all other court proceedings (II(e));


4ļøāƒ£ The right to appear and be heard at any disposition, release, plea, sentencing, or parole proceeding (II(p));


5ļøāƒ£ The right to confer with the prosecution and be consulted about the case’s disposition, including plea bargaining (II(f));


6ļøāƒ£ The right to full and timely restitution or victim compensation for their losses (II(j));


7ļøāƒ£ The right to be treated with fairness, dignity, and respect for safety and privacy (II(a));


8ļøāƒ£ The right to designate counsel to speak or write on the victim’s behalf when making an impact statement or exercising their rights.Ā
